The Mental Health Parity and Addition Equity Act (MHPAEA) rules released on September 9, 2024, by the Departments of Health and Human Services (HHS), Labor, and Treasury (Departments) finalized some of the regulations they proposed in 2023. These rules set out the parameters for the required comparative analysis of nonquantitative treatment limitations (NQTL) to ensure that mental health and substance use disorder (MH/SUD) benefits are not more restrictive than those applied to medical/surgical (M/S) benefits.
